Please read these terms carefully before using BuzzedUp.
Effective August 17, 2026These Terms of Service ("Terms") constitute a legally binding agreement between you and BuzzedUp LLC ("BuzzedUp," "we," "us," or "our") governing your access to and use of the BuzzedUp mobile application ("App") and all related services.
By downloading, installing, accessing, or using BuzzedUp, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use BuzzedUp.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by updating the effective date above. Your continued use of BuzzedUp after any changes constitutes acceptance of the updated Terms.
You must be at least 21 years of age to use BuzzedUp. By using the App, you represent and warrant that you are at least 21 years old and meet the legal drinking age requirement in your jurisdiction.
BuzzedUp is a nightlife discovery platform designed for adults of legal drinking age. We do not knowingly allow use by anyone under 21. If we become aware that a user is under 21, we will take steps to terminate their access and delete any associated data.
You represent that you have the legal capacity to enter into these Terms and are not prohibited from using the App under any applicable law.
BuzzedUp uses anonymous authentication. You do not need to provide an email address, phone number, or other personally identifying information to use the App. A randomly generated anonymous identifier is assigned to your device session.
You may choose a username for display within the App. You are responsible for any activity that occurs under your username or anonymous session. You agree not to:
We reserve the right to reclaim, suspend, or reassign usernames at our sole discretion, including usernames that are inactive, misleading, or violate these Terms.
BuzzedUp is a nightlife information and social discovery platform. We do not sell, serve, distribute, or deliver alcoholic beverages. We do not hold a liquor license and are not a licensed alcohol retailer, distributor, or manufacturer.
The App provides information about nightlife venues, including drink deals and specials, for informational purposes only. Any transactions involving alcohol occur solely between you and the venue. BuzzedUp is not a party to any such transaction and assumes no responsibility or liability for the sale, service, or consumption of alcohol.
You are solely responsible for complying with all applicable laws regarding the purchase and consumption of alcohol in your jurisdiction. BuzzedUp does not encourage excessive or irresponsible alcohol consumption. Please drink responsibly.
BuzzedUp allows users to submit content through the App, including but not limited to: venue activity posts, chat messages, anonymous posts, vibe selections, check-ins, deal ratings, and deal poll votes (collectively, "User Content").
You retain ownership of your User Content. However, by submitting User Content, you grant BuzzedUp a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, display, reproduce, modify, distribute, and otherwise make available your User Content in connection with operating and improving the App. This license continues even if you stop using BuzzedUp, to the extent your User Content has been shared with other users or incorporated into the App's functionality.
You represent and warrant that:
Zero tolerance. BuzzedUp has zero tolerance for objectionable content and abusive users. Content that harasses, threatens, or targets other users will be removed, and the accounts responsible will be terminated.

We reserve the right to remove any content and terminate or restrict access to any user who violates these Terms, without prior notice.
BuzzedUp employs content moderation measures including, but not limited to, automated word filtering, user reporting, and manual review. We reserve the right to remove, hide, or restrict any User Content at our sole discretion, for any reason, without notice.
We are not obligated to monitor all User Content. While we make reasonable efforts to moderate content, we do not guarantee that all objectionable content will be identified or removed promptly. You may encounter User Content that is inaccurate, offensive, or otherwise objectionable.
BuzzedUp is not responsible for User Content posted by its users. User Content reflects the views of the individual user who posted it, not the views of BuzzedUp. We do not endorse, verify, or guarantee the accuracy, completeness, or reliability of any User Content.
Reports of objectionable content are reviewed and acted upon within 24 hours. Content found to violate these Terms is removed, and the user who submitted it is ejected from the platform.
If you encounter content that violates these Terms, please report it through the App's reporting feature or by contacting us at buzzedupapp@gmail.com.
BuzzedUp offers an anonymous posting feature. When enabled, your username is not displayed alongside your posts in venue activity feeds.
Anonymous posting does not mean your activity is untraceable. We retain the ability to associate anonymous posts with your anonymous user session for moderation, safety, and legal compliance purposes. If we receive a valid legal request (such as a court order or subpoena), we may be required to disclose information associated with anonymous posts to the extent we possess it.
Anonymous posting is a privilege, not a right. Abuse of anonymous posting — including harassment, threats, or repeated violations of these Terms — may result in the removal of your content and termination of your access to the App.
BuzzedUp uses your device's GPS to verify your physical proximity to a venue when you check in. By using the check-in feature, you consent to BuzzedUp accessing your device's location data for this purpose.
Check-in data contributes to live venue activity information visible to other users, including your friends. Your check-in may be visible to users who are connected to you through the Friends feature.
You agree not to spoof, manipulate, or falsify your GPS location. Submitting false location data to fraudulently check into venues violates these Terms and may result in termination of your access.
GPS accuracy may vary depending on your device, environment, and other factors. BuzzedUp is not responsible for inaccuracies in location verification.
Vibes are user-submitted assessments of a venue's current atmosphere. They reflect the subjective opinions of individual users and are not verified or guaranteed by BuzzedUp.
Deals displayed in the App are provided by venue partners or sourced from publicly available information. BuzzedUp does not guarantee the accuracy, availability, pricing, or validity of any deal. Deals may change, expire, or be discontinued by the venue at any time without notice to BuzzedUp or its users. Always confirm deals directly with the venue before making decisions based on them.
Venue information — including names, locations, hours, and other details — is provided for informational purposes only. BuzzedUp does not guarantee that any venue is open, operational, or accurately represented in the App.
BuzzedUp is not liable for any loss, cost, or disappointment resulting from reliance on vibes, deals, or venue information displayed in the App.
BuzzedUp allows you to connect with other users through a friends system. By connecting with another user, you consent to sharing certain activity information with them, including your check-ins and venue activity.
You are responsible for managing your own friend connections. BuzzedUp is not responsible for any interactions, disputes, or issues that arise between users, whether connected as friends or otherwise.
You agree not to use the Friends feature or any social feature to stalk, harass, or monitor another person's movements or activities without their knowledge and consent.
BuzzedUp may send you push notifications about relevant activity, including friend activity, venue activity, deals, and other nightlife information. You can disable push notifications at any time through your device's settings.
By enabling push notifications, you consent to receiving these communications. We will make reasonable efforts to ensure notifications are relevant and not excessive.
The BuzzedUp App, including its design, graphics, icons, logos, illustrations, text, software, and all other content created by BuzzedUp (collectively, "BuzzedUp Content"), is owned by BuzzedUp LLC and is protected by copyright, trademark, and other intellectual property laws.
You may not copy, modify, distribute, sell, lease, or create derivative works based on any BuzzedUp Content without our prior written permission.
The BuzzedUp name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BuzzedUp LLC. You may not use these marks without our prior written permission.
BuzzedUp integrates with third-party services to provide its functionality, including but not limited to Firebase (Google), Mapbox, Expo, Netlify, Open-Meteo, and Anthropic. Your use of BuzzedUp may be subject to the terms and privacy policies of these third-party services.
BuzzedUp may display information about or links to third-party venues, businesses, products, or services. We do not endorse, control, or assume responsibility for any third-party content, products, or services. Your interactions with third-party venues or businesses are solely between you and that third party.
BuzzedUp uses artificial intelligence technology to generate business analytics and insights for venue partners. Aggregated, non-personally-identifiable data — such as check-in volumes, vibe trends, and deal performance — may be processed by AI services for this purpose.
The consumer App does not use AI to generate content, recommendations, or decisions directed at individual users. AI-generated business insights are provided to venue partners only and are not guaranteed to be accurate or complete.
BUZZEDUP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
To the fullest extent permitted by applicable law, BuzzedUp LLC disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that:
Your use of the App is at your sole risk. You are solely responsible for any decisions you make based on information provided through BuzzedUp, including but not limited to decisions about which venues to visit, alcohol consumption, and transportation.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BUZZEDUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP.
This limitation applies regardless of the theory of liability (contract, tort, strict liability, or otherwise) and whether or not BuzzedUp has been advised of the possibility of such damages.
In no event shall BuzzedUp LLC's total aggregate liability to you for all claims arising out of or relating to the use of the App exceed one hundred U.S. dollars ($100.00).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
Without limiting the foregoing, BuzzedUp is not liable for:
You agree to indemnify, defend, and hold harmless BuzzedUp LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
Governing Law. These Terms and any disputes arising out of or relating to them or the App shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles.
Informal Resolution. Before initiating any formal legal proceeding, you agree to first contact us at buzzedupapp@gmail.com and attempt to resolve the dispute informally for at least 30 days.
Jurisdiction. If a dispute cannot be resolved informally, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Athens County, Ohio, and you consent to the personal jurisdiction of such courts.
Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against BuzzedUp LLC.
We may suspend or terminate your access to BuzzedUp at any time, for any reason, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violations of these Terms, abusive behavior, fraudulent activity, or extended periods of inactivity.
Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, limitation of liability, indemnification, and dispute resolution.
You may stop using BuzzedUp at any time by uninstalling the App. If you wish to have your data deleted, contact us at buzzedupapp@gmail.com.
You acknowledge and agree that nightlife activities involve inherent risks, including but not limited to risks associated with alcohol consumption, travel to and from venues, interactions with other patrons, and general personal safety.
BuzzedUp provides information to help you make decisions about nightlife activities, but we do not guarantee your safety. You assume all risks associated with your use of the App and any decisions you make based on information obtained through it.
You are solely responsible for your own safety, your own decisions regarding alcohol consumption, and your own compliance with all applicable laws.
Your use of BuzzedUp is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and BuzzedUp LLC regarding your use of the App and supersede all prior agreements.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver. Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or any other provision.
Assignment. You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
No Agency. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and BuzzedUp LLC.
